18 to gamble on the sites no matter what "state" or "country" you're in
taxes on the winnings dont mean anything...you dont have to claim them.. it's not like the gambling sites report their earnings to the IRS. geoff is wrong |

In the U.S., virtually all income is taxable, no matter how it's earned. We do indeed have a spot on our tax forms to report Gambling winnings, so it is supposed to be reported. If people chose not to report any or all of their income, that is their own choice, but they are breaking the law, and it is a REALLY big deal if it ever catches up to them... |

Regarding the Age thing, there is a big "Over 18 Only" icon right on the main page of Party's web site (for example - it's the only one I checked). That links to this page:

not reporting taxes are your gambling winnings isnt any different than what Pete Rose did.
Your going to report taxes on any big winners you have at the horse track, or at the casino. Its not like your telling the IRS "Hi Im reporting winnings on a online poker site where it is illegal for me to gamble at". The poker checks you get dont say 'party poker' on them so it could be from any gambling you are involved in as long as you report it, the IRS wont ask you any questions. On the other hand if you dont report it, the IRS will make it their MO to find as many violations on you as possible. They could charge you with betting online (if possible), being 18 and gambling (18 is okay for the offshore casino but you have to be 21 in your jurisdiction more than likely), etc. |

Actually, I think you're all variations of right and wrong.
First, you DO have to pay taxes on poker (gambling) winnings in the U.S. No, the poker sites aren't reporting your winnings, but YOU are supposed to. If you ever got audited and the IRS asked you where all those deposits to your bank account were coming from, they would nab you. As for how old you need to be to play online poker, that's up to both the gambling site AND your local jurisdiction. In the states, online poker is a big gray area, but don't think that just because these companies are offshore means no laws apply to you. Just because some web site selling kiddie p0rn is located offshore doesn't mean it's legal for you to download it, for example. And you can't go hiring assassins legally, just because their company happens to be located outside the U.S. |
