I created something huge
I was thinking the other day, and created a new ring game style for online or live poker.
I say so myself but its f***in amazing. Ive emailed a very well known poker sites affiliate managers, and some big guy over there is phoning me tomorrow after reading my ideas for a further discussion as to what i want to do with it im selling it of course. its patented and copywrited. Now is the big one. Do i sell it for a one off fee, or try and procure myself a % of all the rake from that game? What would you do, and if they put the game on the site, its gonne be huge, i know it, and i think they do. |

Hmmmmmmmmm.....
GL inventing (and copyrighting, assuming it uses a standard deck) a card game that no one else has ever though of. That's the first thing I have to say. And more importantly, GL making up something that will take off. Most non hold-em games get little to no play these days, no matter ho great they are..... even games that have been extremely popular for 100+ years. I wonder what % of online hands dealt are 7 card stud (which historically, has always been a much bigger game than HE)... I'm thinking it's very, very small. GL though. Keep us posted. |

NOooooooooooooooooo. my bad its the game of holdem. The whole setup of the ring game is changed. Its hard to explain, but more people will play this that normal ring games i think, especially low limit players. high limit would be mroe of a challenge, its based around the 2/4 player FL or NL player. sorry for the confusion |

I wonder if it deals with multiple flops...
And in answer to your question, I would go with rake %. Come on ... you might get a few grand for an idea (or possibly even tens of thousands if it's good), but if it does take off, you stand to make a lot more over the long haul with a rake option.

Ive got it patented, so i dont need to.
Im getting a signed thing from them after our chat. And no, it isnt multiple flops, id hate to try and design that idea. Ill tell you all here when i get some news back from the "site". Edit - and about the rake thing. Say they play 1 table fo it, and this is not gonna happen, it will be alot more, but even if its one table, 80 H/ph, $3 rake p/h, i get say 5%. 5% or $3 = $0.15, 0.15 x 80 = $9. plus $2.50 per game that goes, so $11.50 an hour per table if i get 5%, and thats worst case. I wont need to work if we have 1 table of it, ill be rich if they have 100 like a normal ring game. jesus |

Where did you get it patented? I certainly hope it's in the same jurisdiction as the registered office of the company with whom you've been having these discussions.

I'm no big city lawyer, but I'd also be quite surprised if people were actually able to patent ideas about how to play card games. I mean, that just doesn't make much sense to me.... But maybe it's because I don't understand this idea, since we still don't know what it is.
Hypothetically, say I came up with the idea that every time you found a 2 in your hand, you could post another BB and get a third card. I mean, can I patent that idea and then charge people to use it? I don't think so. Better yet.... Royal Hold'Em (or whatever it's called on UB). Did someone patent that game? Does that mean I'm not allowed to play it in my house or Party can't set up their own version of it? I highly, highly doubt it. What I'm really interested in in seeing what site you are dealing with, as most ignore the thousands of variations of poker games that are out there and only focus on the popular versions. |

If he's put it into a computer program he can patent the software... but even then someone could just write a similar program and probably get around the patent.
As an attorney with an I.P. background I'd be interested in hearing how and where you got your patent on this eejit.

Ill keep ya posted. And i got the idea patented, its a whole new structure e.t.c, i didnt program it, im speaking to a big site who i have dealt with in the past with marketing ideas and so on. Ill let you know tomorrow night what goes on. it may all turn out to be shit, but its a damn good system, and if they put it on the site will have people playing it "fo sho" |

If it's patented, why can't you reveal more details?
There are a few very smart people on these boards - and if you get substantive discussion on your idea (for FREE) it might give you more leverage when you talk to the poker site: you could be more informed, you could swing some heavier words, and you might be able to view things from another perspective.

Umm, no, and im beginning to think ive done it arse way round.
You can get patentcy stuff ordered online, they send it round to your house, you send it off e.t.c I dont know if my laws and yours are the same, but ive basically put a little thing on my idea that means noone else can pass it off as theirs, unless they can prove beyond any doubt they had invented it earlier. Which is hard unless you got abraham lincoln to sign something on your work sheet But yes, i should have got more advice, and yes, i will be asking everyones advice from here. |

Well, you're being very discreet about the details, and that's fine, but if it's as "big" as you suggest, I'm confused why you wouldn't want a rake-type compensation option (if that becomes available to you). The way you're playing this up, it sounds like something that could *possibly* change your life. Don't throw that away for $5,000 or $10,000.
Let us know what happens.

That sounds a lot more like a copyright than a patent... patents, at least here in the U.S. (and I would think in the U.K.), are very expensive and time consuming to obtain. You have to have a patent lawyer (a specialist that must pass the patent bar) file your application with the U.S. Patent Office and then it gets examined and only goes to registration if it's patentable and does not infringe any existing patents. Not something you can do via mail order or on-line (copyright however you can do that, it's a much more simple process).
In any event, I would really suggest that you get them to sign a confidentiality agreement with a non-compete clause because I'm now pretty certain that the intellectual property rights in your idea are not as locked up as you might think.

1- thanks to our resident lawyer nd resident asshole for their help, + reps for both when i can +rep you again RD. 2- yes, copywrite is it. Apparently from someone i know here patenting is mroe important, but i dont have the money for it and a copywrite will do te job. I am getting something signed from the site now too, thanx. 3 - I always wanted a rake option if i can, nothing big mind, just small, so i wont ever need to work again. If i get 1% and they run 100 tables, ill be earning $1,5 million a year. HOLY SHIT, wont happen, but it might 4- why didnt i go to law school? |

It has it's benefits, but it also has it's drawbacks. Consider yourself lucky that you're not paying off student loans in excess of $100,000.
