Bingo. This is one of the arguments for "Game of Skill." A bigger one is that the IRS allows you to declare yourself a professional poker player and write off your losses as a business expense! Note that you can not write off losing lottery tickets, since that very different form of gambling is seen as a game of chance.
In oher words, the IRS sees poker as a game of skill. One of the big problems here though, is that's at the Federal Level... and I believe if a state decided to make poker illegal (or gay marriage or whatever), they have that right. Proposition whatever the heck it is may never get through, but 2Tone may still be screwed in Washington State. |

Chance is the predominating factor in the outcome of an individual hand.
Skill is the predominating factor in the FINANCIAL outcome of an individual session (betting more when you're ahead, less when you're behind, etc).

Customer service -- Govenor's office vs. Party
Who is more responsive to email, my state government or Party poker support? Based on a sample size of 1 ...
Party is faster. I just got this after having sent my letter over a week ago. But the Govenor's office staff has a better command of English. Neither seem to ever address the actual content of the question/request. My letter to the Gov. centered on why the state government felt it neccesary to make Internet poker a felony, which is never addressed in this response. Oh well. Thank you for contacting Governor Gregoire concerning Senate Bill 6613 and Internet gambling. Before she signed this bill, it was already illegal to gamble over the Internet under both state and federal law. That is why all these Internet gambling sites are located off shore. It is difficult, although not impossible, to prosecute offenders for Internet gambling. The bill clarifies that gambling over the Interned is illegal and brings the older statute up to date. It also clarifies that the state cannot offer gambling over the Internet without a 60 percent approval vote. The only exception to this law is in horse racing through the Advanced Deposit Wagering law. Again, thank you for your message. Sincerely, Constituent Services Office of the Governor |

Just four more days until 2Tone becomes a felon. I'll be really interested to see how this plays out. My guess is they won't prosecute anyone for JUST playing online poker. But what do I know?
