This is all going to hinge on whether Leyser can prove the existence of a valid and enforceable agreement between him and Gold. There's no way the injunction gets lifted, there only has to be a reasonable chance that Leyser can win on the merits and I think he is easily over that hurdle. There's also no way Gold gets this tossed out via Summary Judgment, there are just too many facts in dispute for this not to go to trial. So, it's going to trial and it looks to me like Leyser has a very good chance of proving there was a valid and binding verbal agreement in place.

P.S. - It sounds like Gold's depo was a disaster for the defense.
